Labour law disputes refer to legal disputes arising from employment relationships. These disputes usually arise from issues related to the rights and obligations between the employee and the employer. Basic information about labor law disputes is as follows:

  1. Disputes Arising from Employment Contract:

    • Most labor law disputes arise from the employment contract between the employee and the employer. Disputes between the parties usually arise on issues such as the terms of the employment contract, compensation, working conditions, and workers' rights.

  2. Reinstatement Cases:

    • Reinstatement cases refer to cases filed by the employee due to dismissal. According to the Labor Law, judicial review of dismissals without just cause is carried out through such cases.

  3. Job security:

    • Job security is the protection of workers who meet certain conditions against termination of their employment contract without a justified reason. Job security disputes evaluate the legality of the dismissal of an employee.

  4. Work Accidents and Occupational Diseases:

    • Disputes arising in case of work accidents and occupational diseases include whether the employer fulfills its occupational health and safety obligations, workers' rights and compensation claims.

  5. Union and Collective Labor Relations:

    • Disputes arising on issues such as union membership, collective bargaining agreements and strikes are evaluated within the scope of labor law. Such situations are often the result of negotiations and disputes between the union and the employer.

  6. Employer and Worker Rights:

    • Employer and employee rights include disputes that may arise, especially regarding issues such as working hours, leaves, wages and social rights. Labor law seeks solutions between the parties in case of violation of these rights.

  7. Mediation and Litigation:

    • The mediation process is frequently used in resolving labor law disputes. In addition, labor courts are responsible for resolving such disputes in case a lawsuit is filed.

Labor law disputes are usually resolved in labor courts, but alternative solutions such as mediation may be used first. Labor law is an important branch of law in order to maintain the balance between employee and employer and to provide a fair working environment.
